A polícia em Portugal no século XVIII: ambiguidades e equívocos

    The charter of 25 June 1760 creating the post of Intendant-General of the Police of the Court and Kingdom – not an Intendancy-General of Police as it is often called – has been presented as an important innovation of Pombal’s administration, an instrument of the police state that was beginning to take shape. Without questioning the extent of the political changes taking place, this article contends that the document in question was rooted in a tightly constrained, conservative legal framework and did not have the disruptive impact that has been attributed to it. Nor, in terms of policing, did it align Portugal with the “more refined courts” that according to the charter the government wished to emulate. Furthermore, it is argued that substantive changes in the way the Police of the Court and Kingdom operated only occurred after 1780 amid controversy and persistent uncertainty as to its intendant’s powers.

    O alvará de 25 de junho de 1760, que criou o cargo de Intendente-Geral da Polícia da Corte e do Reino, e não uma Intendência-Geral da Polícia como comummente é referido, tem sido apresentado como uma importante inovação do governo do conde de Oeiras, um instrumento do estado de polícia que se começava a formar. Sem questionar a dimensão das transformações políticas em curso, defende-se neste texto que o documento em causa, ancorado num quadro legal circunscrito e pouco inovador, não provocou os efeitos disruptivos que lhe têm sido atribuídos, nem colocou Portugal, no que à polícia concerne, ao lado das “cortes mais polidas” que no dito diploma o governo afirmava querer emular. Defende-se, ainda, que mudanças substantivas na atuação da polícia da corte e do reino só terão ocorrido a partir de 1780, num ambiente de contestação, mas, também, de persistência da indefinição das competências do seu intendente.
