  PROBLEMA: en la práctica jurídica contemporánea, el derecho a una buena motivación ha adquirido importancia fundamental para el debido proceso. La motivación de la sentencia constituye una de las formas de realizar la tutela judicial efectiva de los derechos. Aclarar en qué consiste la motivación de una sentencia en derecho penal. Se ha trabajado con nociones que todavía pueden desarrollarse con mayor profundidad, como es el caso de la sana crítica razonada. OBJETIVO: esclarecer la idea de motivación de la sentencia en términos de la teoría de la argumentación. MÉTODO: Esta es una investigación cualitativa que analiza la estructura racional de la argumentación de la sentencia judicial. Se sostiene como hipótesis que los modelos de teoría de la argumentación ayudan a entender la estructura de la motivación de la sentencia. RSULTADO: muestra que la justificación de la sentencia es una estructura racional analizable bajo la óptima de la teoría de la argumentación. CONCLUSIÓN: se afirma que es necesario formar a los jueces en los rudimentos de tal teoría, con el objeto de que puedan brindar sentencias mejor estructuradas y convincentes, dentro del Estado constitucional de derecho.

  PROBLEM: in contemporary legal practice, the right to good reasoning has acquired fundamental importance for due process. The motivation of the sentence constitutes one of the ways to carry out the effective judicial protection of rights. Clarify what the motivation of a sentence in criminal law consists of. We have worked with notions that can still be developed in greater depth, as is the case of sound reasoned criticism. OBJECTIVE: to clarify the idea of ​​motivation of the sentence in terms of the argumentation theory. METHOD: This is a qualitative research that analyzes the rational structure of the argumentation of the judicial sentence. It is sustained as a hypothesis that the models of argumentation theory help to understand the structure of the motivation of the sentence. RESULT: shows that the justification of the sentence is a rational structure analyzable under the optimum of the argumentation theory. CONCLUSION: it is stated that it is necessary to train judges in the rudiments of such theory, so that they can provide better structured and convincing sentences, within the constitutional rule of law.
