El Código Orgánico General de Procesos, ha instaurado el procedimiento monitorio a través del cual los propietarios de deudas determinadas, líquidas, exigibles y de plazo vencida que no consten en un título ejecutivo y que no excedan de los cincuenta salarios básicos unificados (SBU) del trabajador, puedan ejercer su derecho de cobro, garantizando que este procedimiento sea célere y efectivo, contribuyendo así a descongestionar los procesos de administración de justicia. Este procedimiento incluye el patrocinio de un abogado, con una limitante: si el salario es inferior a los tres salarios básicos unificados (SBU) no se requiere este patrocinio; lo cual contraría lo dispuesto en la Constitución que expresa que todo trámite judicial requiere el patrocinio de un abogado, además en la práctica los casos presentan una oposición a la demanda lo cual conlleva a una audiencia única, para lo cual las partes requieren para su defensa de un abogado, a quien también se le limita el derecho al trabajo. Frente a esta situación se aborda la importancia de que el patrocinio de un abogado sea un requisito obligatorio independientemente de la cuantía de la obligación.
The General Organic Code of Processes, has established the order for payment procedure through which the owners of determined, liquid, demandable and overdue debts that do not appear in an executive title and that do not exceed fifty unified basic salaries (SBU) of the worker, can exercise their right to payment, guaranteeing that this procedure is swift and effective, thus contributing to decongesting the justice administration processes.
This procedure includes the sponsorship of a lawyer, with one limitation: if the salary is less than three unified basic salaries (SBU), this sponsorship is not required; which is contrary to the provisions of the Constitution, which states that all legal proceedings require the sponsorship of a lawyer, in addition, in practice, the cases present an opposition to the lawsuit, which leads to a single hearing, for which the parties require for their defense of a lawyer, whose right to work is also limited. Faced with this situation, the importance of the sponsorship of a lawyer being a mandatory requirement regardless of the amount of the obligation is addressed.
