  • Very few principles could cut across centuries and different legal cultures, as the ne bis in idem principle did it. This study analyses the evolution of criminal justice in the light of the transformations that this fundamental human safeguard has undergone in the last decades in an era increasingly characterised by a strong inter-legality. A set of dynamic relationships among legal systems can already be observed in domestic jurisdictions, particularly in the European regional scenario in which European case-law has promoted autonomous concepts that have led to a complex network regarding criminal and non-criminal proceedings. But the highest degree of legal interaction is achieved in the transnational scenario, where the ne bis in idem principle allows us to look with clarity at the process through which a criminal-law decision can become res iudicata and the extent this can be accepted by other jurisdictions, and hence at the way in which criminal law materialises in relation to specific human behaviours.
