Resumen de Ne bis in idem transnazionale

  • The ne bis in idem principle is one of the fundamental guarantees in criminal procedure law. According to it, a second prosecution within the same jurisdiction and for the same material fact is prohibited in cases already ended by a final decision. Article 50 CFR (Charter of Fundamental Rights) extends the principle's scope to the transnational framework in the sense that a final decision in one EU Member State represents an obstacle to new proceedings for the same acts in other Member States. The limitations to the ne bis in idem principle must meet the requirements provided for by Art. 52, para. 1, CFR.

    Articles 54 and 55 CISA (Convention implementing the Schengen Agreement) had already introduced other limitations to this principle, posing coordination problems between sources of European law.
