Immigration criminal law offers an emblematic representation of the involution that seems to characterize contemporary criminal law (or, perhaps, it would be more correct to say punitive law).
The essay analyzes the most problematic profiles of the Italian criminal law on the facilitation of illegal immigration. In particular: the uncertain border that characterizes the relationship between trafficking and smuggling in Italian criminal law; the possible criminalization – direct and/or indirect – of the so-called “humanitarian smuggling”; the disproportion of the sanctioning treatment for the crime of facilitation of illegal immigration, provided for by art. 12 T.U. Immigrazione.
In order to correct these critical issues, a radical change of perspective is hoped that shifts attention from the protection of the regulation of migratory flows to the protection of the fundamental rights of migrants.
