El objetivo general de la investigación fue analizar jurídicamente el indulto como medida eficaz para garantizar el derecho a la salud. Los investigadores se plantearon como método para el desarrollo del trabajo de investigación el enfoque cuantitativo, mediante la exploración, recolección y análisis crítico mediante una tipología documental, apoyada con el diseño bibliográfico. Al respecto, se examinaron y analizaron fuentes documentales a nivel teórico, tesis, norma, leyes y trabajos arbitrados vinculadas con los aspectos centrales del trabajo. Se aplicó veinte encuestas a abogados en el libre ejercicio del cantón Santo Domingo. Se concluye que, el indulto concedido mediante el Decreto Ejecutivo 1086 precauteló el derecho a la salud de 66 sentenciados que se ubican entre los requisitos tales como ser adultos mayores sentenciados, habitar con niñas y niños de edades inferiores a tres años, ser sentenciados con discapacidad y con enfermedades catastróficas y crónicas

The general objective of the research was to legally analyze the pardon as an effective measure to guarantee the right to health. The researchers proposed a quantitative approach as a method for the development of the research work, through exploration, collection and critical analysis by means of a documentary typology, supported by bibliographic design. In this regard, documentary sources at the theoretical level, theses, regulations, laws and refereed works related to the central aspects of the work were examined and analyzed. Twenty surveys were applied to lawyers in free practice in the canton of Santo Domingo. It is concluded that the pardon granted by Executive Decree 1086 safeguarded the right to health of 66 convicted persons who meet the requirements such as being sentenced seniors, living with children under three years of age, being sentenced with disabilities and with catastrophic and chronic diseases.
