  El objetivo general de la investigación fue analizar jurídicamente la mutación constitucional y la rigidez de la constitución. Se desarrolló desde el paradigma cuantitativo, además se enmarcó desde un diseño documental-bibliográfico, mediante la indagación, recolección y análisis crítico documental y referencial bibliográfico, basándose en la exploración metódica, rigurosa y profunda de diversas fuentes documentales tales como investigaciones científicas, leyes, artículos, trabajos arbitrados y tesis. Describiendo los hallazgos encontrados. Por otro lado, la técnica que será utilizada es la encuesta. La muestra se conformó por ocho expertos en la materia constitucional. Se Concluye que, la mutación constitucional ejercida a través de la interpretación, viola el debido proceso de reforma e inobserva el artículo 84 de la Constitución que prohíbe que la reforma o los actos de los poderes públicos atente contra los derechos que reconoce la propia norma, bajo esta consideración no es atribuible a los jueces constitucionales realizar interpretación arbitraria.

  The general objective of the research was to legally analyze the constitutional mutation and the rigidity of the constitution. It was developed from the quantitative paradigm, it was also framed from a documentary-bibliographic design, through the inquiry, collection and critical documentary and bibliographic referential analysis, based on the methodical, rigorous and deep exploration of various documentary sources such as scientific research, laws, articles, refereed works and theses. Describing the findings. On the other hand, the technique that will be used is the survey. The sample consisted of eight experts in constitutional matters. It is concluded that the constitutional mutation exercised through interpretation violates the due process of reform and does not comply with Article 84 of the Constitution, which prohibits that the reform or the acts of the public powers attempt against the rights recognized by the norm itself, under this consideration it is not attributable to the constitutional judges to perform arbitrary interpretation.
