Resumen de Vulneración del derecho al debido proceso en el procedimiento abreviado

  El objetivo general de la investigación fue analizar jurídicamente la vulneración del principio de seguridad jurídica en la adquisición de la nacionalidad ecuatoriana. El método de la presente investigación se desarrolló desde el enfoque cuantitativo, a través de la búsqueda, recolección y análisis crítico documental, referencial bibliográfico y estudios o proyectos de investigación. Desde un diseño bibliográfico de tipo documental, cuya indagación desde la reflexión crítica, se construyó el método de análisis del fenómeno de estudio, considerando leyes, normas nacionales e internacionales y tesis, lo que condujo a la obtención de información relevante y la construcción del tejido teórico. Se concluye que, el cometimiento como auto incriminación no es una medida idónea, necesaria ni proporcional para alcanzar los fines del Decreto 1081 (2015) y administrar la justicia, por eso, se debería conseguir esos objetivos mediante otras medidas.

  The general objective of the research was to legally analyze the violation of the principle of legal certainty in the acquisition of Ecuadorian nationality. The method of this research was developed from the quantitative approach, through the search, collection and critical analysis of documents, bibliographic references and studies or research projects. From a bibliographic design of documentary type, whose inquiry from the critical reflection, the method of analysis of the study phenomenon was built, considering laws, national and international norms and theses, which led to obtaining relevant information and the construction of the theoretical fabric. It is concluded that, committing as self-incrimination is not a suitable, necessary or proportional measure to achieve the purposes of Decree 1081 (2015) and administer justice, therefore, those objectives should be achieved through other measures.
