Resumen de Mujer y matrimonio: El delito de bigamia como ruptura del sacramento en la Edad Moderna

  El matrimonio, como primer paso a la familia y al parentesco, ha supuesto el génesis de la estructura social y modelo poblacional que ha regido tanto a las comunidades de antaño como a las de hoy en día; independientemente de su emplazamiento geográfico y cultural. En el caso de la órbita cristiana, en cuya mentalidad se centra el presente trabajo, el vínculo conyugal comenzó a tomar parte de la sociedad ya desde los primeros años de esta religión, aunque fue a partir de la Sesión XXIV del Concilio de Trento (1563) cuando se reconoció el matrimonio como un sacramento de la Iglesia, condenando, a su vez, a todos los que negaban que lo fuera. Hasta entonces, muchos vínculos que se celebraban se desarrollaban dando lugar a situaciones anómalas como la coexistencia de dos matrimonios en una misma persona, fenómeno que se ha venido a denominar “bigamia”. Como respuesta a un problema endémico al que mostrar especial importancia, Iglesia y Corona desarrollaron durante los siglos modernos un corpus normativo para perseguir a bígamos, acabando con aquellos que hacían temblar la estructura y organización social basada en la existencia de una jerarquía familiar.

  Matrimony, as a first approach towards family, baceme the genesis of the social structure and the population model under which both past and contemporary communities have developed. The present work delves into the mindset of the modern era Cristian sphere of influence. The marital bond had already taken part in Cristian societies from the early days of this religion, but it was not until the XXIV session of the Council of Trent was held (1563) that matrimony was avowed as a sacrament of the Church as a measure against the rise of protestant ideas, further condemning those who denied the sacramental status of marriage.

  In history, a great deal of the spousal relationships eventually led to anomalous situations, such as the coexistence of two marital bonds in the same person, the so-called "bigamy" phenomenon. This paradigm became a major issue that both the Church and the Crown deemed as a very pressing endemic concern. As such, these institutions developed a normative corpus during the modern centuries with the goal of prosecuting bigamous individuals. Thus, they seeked to put an end to those who could cripple the social structure, grounded on the existence of a family hierarchy.
