El asilo eclesiástico en la Nueva Granada en el siglo XVIII: Choque de poderes y tránsito hacia la secularización de la justicia

    Bajo el marco de la historia eclesiástica y la historia judicial y, con base en la revisión de 14 expedientes consultados en los fondos del Archivo General de la Nación de Colombia y en algunos archivos regionales y eclesiásticos, este trabajo tiene por meta analizar el asilo en sagrado durante el siglo XVIII en la Nueva Granada. En esta investigación queda al descubierto cómo individuos de distintas condiciones sociales y económicas recurrieron a esta fórmula de protección, desde los más humildes hasta funcionarios letrados y militares. Varios fueron los motivos esgrimidos para buscar amparo en sitios sagrados, desde factores externos como las condiciones logísticas del sistema penal hasta causas personales como el afán de librarse de amenazas o del accionar de la justicia. De manera progresiva, el gobierno monárquico restringió tanto los espacios como los delitos que eran objeto de esta inmunidad divina mientras que la Iglesia vio socavados sus privilegios al perder cada vez más su poder de influencia en este tipo de casos. Resultado de esta pugna de intereses fueron los continuos choques entre la autoridad civil y la autoridad eclesiástica.

    Under the framework of ecclesiastical history and judicial history and, based on the review of 14 files consulted in the funds of the General Archive of the Nation of Colombia and in some regional and ecclesiastical archives, this work aims to analyze asylum in sacred during the eighteenth century in New Granada. This investigation reveals how individuals from different social and economic conditions resorted to this protection formula, from the most humble to legal and military officials. There were several reasons given for seeking shelter in sacred sites, from external factors such as the logistical conditions of the penal system to personal causes such as the desire to get rid of threats or the actions of justice. Progressively, the monarchical government restricted both the spaces and the crimes that were the object of this divine immunity while the Church saw her privileges undermined by losing more and more its power of influence in thistype of case. The result of this conflict of interests were the continuous clashes between the civilauthority and the ecclesiastical authority.
