  El presente artículo tiene como objetivo: Analizar la vulneración de los derechos constitucionales, la reparación integral de la víctima del delito de violación, si es un derecho exclusivo o es una pena que responde a la teoría de retributiva. Dada la vigencia del Código Orgánico Integral Penal y la inclusión de los derechos de la víctima que deben ser adecuados a los derechos previstos en la Constitución y en los instrumentos internacionales de derechos humanos. Esta realidad se presenta más evidente y cruel en las víctimas del delito de violación, por cuanto la materia de tipo penal genera mayor alarma social y repercute en graves daños materiales e inmateriales para la víctima, requiriendo mayor enfoque y atención por parte del Estado.

  The present article aims to: Analyze the violation of constitutional rights, the integral reparation of the victim of the crime of rape, if it is an exclusive right or is a penalty that responds to the theory of retributive. Given the validity of the Organic Comprehensive Criminal Code and the inclusion of the rights of the victim that must be adequate to the rights provided for in the Constitution and in international human rights instruments. This reality is more evident and cruel in the victims of the crime of rape, as the matter of a criminal type generates greater social alarm and results in serious material and immaterial damages for the victim, requiring greater focus and attention from the State.
