Resumen de Nuevo impulso a la mediación en el Reglamento Bruselas II ter y las dificultades de su implementación en la práctica

La promoción de la mediación y otros mecanismos alternativos de resolución de conflictos (MARC) en todos los asuntos que afecten a menores es una de las cuestiones más destacables del Reglamento Bruselas II ter. Por un lado, introduce como regla general la obligación del órgano jurisdiccional de invitar a las partes a que consideren el recurso a la mediación o a otro MARC. Por otro lado, presta una especial atención al reconocimiento y la ejecución de los acuerdos alcanzados entre las partes con fuerza ejecutiva en el Estado miembro de origen. Ambas medidas son muestra de la firme apuesta del legislador de la UE por las vías alternativas de resolución de los conflictos en esta materia. No obstante, todavía persisten retos pendientes, no resueltos por el Reglamento Bruselas II ter, que ponen en duda si esta nueva regulación supondrá el impulso definitivo a la mediación, o se quedará en un brindis al sol, lleno de buenas intenciones.

The promotion of mediation and other alternative dispute resolution mechanisms (ADR) in all matters that affect minors is one of the most notable issues of the Brussels II ter Regulation. On the one hand, it introduces as a general rule the obligation of the court to invite the parties to consider recourse to mediation or to another MARC. On the other hand, it pays special attention to the recognition and enforcement of agreements reached between the parties with enforceable force in the Member State of origin. Both measures are proof of the EU legislator's firm commitment to alternative ways of resolving conflicts in this matter. However, there are still pending challenges, not resolved by the Brussels II ter Regulation, which cast doubt on whether this new regulation will be the definitive boost to mediation, or will remain a empty effort, full of good intentions.
