Este Comentario jurisprudencial analiza los procesos judiciales que se ha desarrollado ante las Cortes del Reino Unido, para determinar quién tiene la autoridad para dar instrucciones sobre las reservas internacionales de Venezuela en Oro depositadas en el Banco de Inglaterra, a raíz del reconocimiento por parte del Gobierno británico del Sr. Juan Guaidó como Presidente interino de Venezuela, y del consecuente desconocimiento del Sr. Nicolás Maduro como tal Presidente.
Las Cortes británicas, siguiendo el principio de “una sola voz,” han reconocido sin discusión la validez de los actos dictados por el Sr. Guaidó, y además, han negado el reconocimiento de las sentencias de la Sala Constitucional del Tribunal Supremo de Justicia de Venezuela anulatorias de sus actos, ante todo por haber sido dictadas in audita parte en violación de los principios de justicia natural (debido proceso).
This article analyzes the judicial processes that has been developed before the Courts of the United Kingdom, to determine who has the authority to give instructions on the Venezuelan international reserves in Gold deposited in the Bank of England, following the recognition by the British Government of Mr. Juan Guaidó as Interim President of Venezuela, and the consequent non recognition of Mr. Nicolás Maduro as such President. The British Courts, following the principle of “one voice,” have recognized without discussion the validity of the acts dictated by Mr. Guaidó, and in addition, have denied the recognition of the judgments of the Constitutional Chamber of the Supreme Tribunal of Justice of Venezuela annulling his acts, first of all for having been issued in audita parte in violation of natural justice principles (due process).
