    Se aborda en el presente trabajo el debate sobre el cambio de modelo en la fase de instrucción del proceso penal pasando de la tradicional función instructora atribuida a los jueces conforme al propuesto por la más que centenaria Ley de Enjuiciamiento Criminal de 1882, al de un fiscal investigador sujeto, , en cuanto a intervención de derechos fundamentales, a un juez de garantías. Lo que conlleva un análisis sobre su conveniencia, y sobre la situación actual de nuestro sistema procesal penal y el del entorno europeo en el que nos desenvolvemos.

    The debate on the change of model in the investigation phase of the criminal process is addressed in the present work, going from the traditional investigative function attributed to the judges according to the one proposed by the more than hundred-year-old Criminal Procedure Law of 1882, so that of a prosecutor investigator subject, in terms of intervention of fundamental rights, to a judge of guarantees. What entails an analysis on its convenience, and on the current situation of our criminal procedure system and that of the European environment in which we operate.
