Resumen de Análise da eficácia da lei do IPTU-Verde no município de Caruaru-PE

  The main objective of this work is to verify if the extrafiscality of the IPTU-Green in the municipality of Caruaru works as an induction mechanism in the preservation of the environment. The identification of the extrafiscality mechanism is especially important to verify the capacity for action of cultural and social change. This work aims to deepen the study of sustainable construction actions in the municipality of Caruaru, established within the municipality through Complementary Law No. 62/2018. The method applied in the research was the inductive method, a legal foundation of the instrument of induction of environmental preservation through the extrafiscality of the IPTU-Green was carried out; and the survey through data collected from the Municipality Urbanization and Environment of Caruaru to verify the architectural projects in accordance with the indications of the Law of IPTU-Green of Caruaru. It was found that the measures proposed in the municipal program of the IPTU-Green de Caruaru are important in the sustainable urban follow-up. However, without success in the municipality of Caruaru, considering the legal doctrine, it is observed that the behavior of the agents responsible for the constructive development of the municipality of Caruaru did not exercise the extrafiscality function of the IPTU-Green, as it is presented in a motivational-conscious and not punitive.

  O objetivo principal deste trabalho é verificar se a extrafiscalidade do IPTU-Verde do munícipio de Caruaru funciona com mecanismo de indução na preservação do meio ambiente. A identificação de mecanismo de extrafiscalidade é importante principalmente para verificar a capacidade de ação da mudança cultural e social. O presente trabalho visa aprofundar o estudo sobre as ações de construção sustentáveis no município de Caruaru, instituído no âmbito do munícipio através da Lei Complementar n°62/2018. O método aplicado na pesquisa foi o método indutivo, uma fundamentação jurídica do instrumento de indução de preservação do meio ambiente através da extrafiscalidade do IPTU-Verde foi realizada; e o levantamento através de dados coletados junto a Autarquia Urbanização e Meio Ambiente de Caruaru para verificação dos projetos arquitetônicos em conformidade com as indicações da Lei de IPTU-Verde de Caruaru. Constatou-se que as medidas propostas no programa municipal do IPTU-Verde de Caruaru são importantes no seguimento sustentável urbano. Porém sem eficácia no município de Caruaru, considerando a doutrina jurídica observou-se que o comportamento dos agentes responsável pelo desenvolvimento construtivo do município de Caruaru não exerceu a função da extrafiscalidade do IPTU-Verde, por esta se apresentar de forma motivacional-consciente e não punitiva.
