El delito de hurto y su evolución histórica

    En este material se expresa las consideraciones sobre el delito de hurto, así como su evolución histórica. En los momentos iniciales se abordan sus orígenes en el derecho romano, el tratamiento que recibe en el decursar histórico, su tratamiento en las leyes cubanas y se realiza una comparación con su normalización en los países latinoamericanos. En la investigación se asume la concepción materialista de la historia para explicar la problemática investigada desde un enfoque general e integral que se sustenta en métodos propios de la investigación en las ciencias sociales. Desde esta mirada se sigue la lógica de la ciencia y del contenido para estructurar el delito dentro del Derecho Penal como ciencia y asignatura. Además, si bien se refleja la necesidad de comprender en la evolución de concepto la relación ciencia asignatura la investigación constituye el soporte para las consideraciones y experiencias didácticas que se sustentarán en los próximos trabajos.

    This material expresses the considerations on the crime of theft, as well as its historical evolution. In the initial moments, its origins are addressed in Roman law, the treatment it receives in the historical course, its treatment in Cuban laws and a comparison is made with its normalization in Latin American countries. In the investigation the materialist conception of the history is assumed to explain the problematic one investigated from a general and integral approach that is sustained in methods own of the investigation in the social sciences. From this perspective, the logic of science and content is followed to structure crime within the Criminal Law as a science and subject. In addition, although it reflects the need to understand in the evolution of concept the relation science subject research constitutes the support for the considerations and didactic experiences that will be sustained in the next works.
