La acción de protección, es considerad un recurso, el mismo es aplicado para obtener la reparación inmediata de un derecho que haya sido vulnerado, aplicando un procedimiento constitucional. Los jueces que hacen parte del poder judicial, son considerados jueces constitucionales, su función principal es conocer, activar el sistema judicial de manera prolija y determinar de manera fundamentada y motivada si existe la vulneración de un derecho constitucional, esta vía puede ser activada en contra del Estado o de una persona natural. Una vez determinada la vulneración de un derecho, el juez de inmediato solicita a la parte accionante que proceda con la reparación integral.
El objetivo de la presente investigación es determinar si los procedimientos de acción de protección que conocen los jueces constitucionales del cantón Azogues tienen cumplimiento eficaz a favor de funcionarios públicos de la Dirección Distrital del MAG Cañar en el periodo enero – diciembre 2022. La metodología que se aplicó para la presente investigación es cualitativo y cuantitativo. El nivel de investigación es descriptivo y el corte es transversal comprendido en el período enerodiciembre 2022. El universo a estudiar son 9 sentencias en contra de la Dirección Distrital del MAG Cañar.
Como resultado de la investigación es importante destacar que los problemas en la actualidad no versan con las leyes, que ya tienen su tiempo en el ordenamiento jurídico, por tal manera se determina que los procesos no cumplen con eficacia, eficiencia, celeridad y reparación, siendo estas características propias de una acción de protección. Por lo tanto, pese a que la institución ha realizado su mayor esfuerzo por reparar integralmente a sus funcionarios, acorde con la sentencia, hay una gran limitación para lograrlo.

The protection action is considered a resource, it is applied to obtain the immediate repair of a right that has been violated, applying a constitutional procedure. The judges that are part of the judiciary are considered constitutional judges, their main function is to know, activate the judicial system in a neat manner and determine in a well-founded and motivated manner if there is a violation of a constitutional right, this way can be activated against of the State or of a natural person. Once the violation of a right has been determined, the judge immediately requests the plaintiff to proceed with full reparation.
The objective of the present investigation is to determine if the protection action procedures known by the constitutional judges of the Azogues canton have effective compliance in favor of public officials of the District Directorate of the MAG Cañar in the period January - December 2022. The methodology that is applied to the present investigation is qualitative and quantitative. The level of investigation is descriptive and the cut is cross-sectional between the period January-December 2022. The universe to study are 9 sentences against the District Directorate of MAG Cañar.
As a result of the investigation, it is important to highlight that the problems at present do not deal with the laws, which already have their time in the legal system, in such a way it is determined that the processes do not comply with effectiveness, efficiency, speed and repair, being these characteristics of a protection action. Therefore, despite the fact that the institution has made its best effort to fully compensate its officials, according to the sentence, there is a great limitation to achieve it.
