Resumen de A livre iniciativa como fator de desenvolvimento na ordem econômica

  The purpose of this article is to deal with free enterprise as a factor of development in the Economic Order. In order to achieve the objective, the research started with the general aspects related to the constitutionalization of the Economy, formed in an Economic Constitutional Order. Then it was about the economic systems of production until the establishment of free enterprise in all its scope. Soon after, there was the legislative evolution of free initiative, in Brazilian Law, with the explanation of its concept and legal nature. Afterwards, it was demonstrated that the reach of Development goes beyond the idea of ​​full freedom, going beyond mere economic growth. To reach the scope, the research sought to carry out a bibliographic review on the theme, as well as using a quantitative methodology, using statistical data extracted from official sources. The research converges to the demonstration that economic freedom is essential for the achievement of the development of a country and efforts must be made to rescue informality, constituting the duty of the State to create instruments that stimulate entrepreneurial initiative and that guarantee the flow and security transactions.

  O presente artigo tem por objeto tratar da livre iniciativa como fator de desenvolvimento na Ordem Econômica. Para o alcance do objetivo a pesquisa iniciou pelos aspectos gerais relativos à constitucionalização da Economia plasmada em uma Ordem Constitucional Econômica. Em seguida se tratou dos sistemas econômicos de produção até à consagração da livre iniciativa em toda a sua envergadura. Logo depois, se verificou a evolução legislativa da livre iniciativa, no Direito Brasileiro, com a explanação de seu conceito e natureza jurídica. Após se demonstrou que o alcance do Desenvolvimento perpassa pela ideia de plena liberdade indo além do mero crescimento econômico. Para o alcance do escopo, a pesquisa buscou realizar uma revisão bibliográfica sobre o tema, bem como se valeu de uma metodologia quantitativa, por meio de dados estatísticos extraídos de fontes oficiais. A pesquisa converge para a demonstração de que a liberdade econômica é essencial para alcance do Desenvolvimento de um país devendo ser empreendido esforços para o resgate da informalidade constituindo dever do Estado a criação de instrumentos que estimulem a iniciativa empreendedora e que garantam o fluxo e a segurança jurídica das transações.
