Resumen de Aportaciones de la Corte interamericana a la tutela de los derechos humanos

Sergio García Ramírez

  • This article gives an account of the establishment of the Inter-American Court of Human Rights (1979) at a time when there were other international justice bodies that influenced the Court’s design and procedures. Inter-American Court advocates surmounted diverse obstacles, such as issues of sovereignty, subjects of international law and domestic jurisdiction. After more than forty years, the Court has rendered invaluable service in shaping inter-American law, especially in Latin America, by way of advisory opinions, judgments, provisional measures, compliance with judgment and other actions. This paper also provides information on key issues in the Court’s role in transforming case-law, including general State obligations, cases of extreme violence, comprehensive reparation, vulnerable subjects, democracy, access to justice, conventionality control, compliance and transcendence.
