Resumen de Juez de garantías en Brasil y en España: Análisis de Derecho Comparado del Desarrollo del Instituto en los Ordenamientos Brasileño y Español

El presente trabajo de investigación objetiva estudiar el instituto jurídico del juez de garantías. Tras una comprensión inicial de tal instituto jurídico, especialmente de su concepto, sus características y los fundamentos que justificarían su institución, analizaremos la relación con los ordenamientos jurídicos brasileño y español. En tal investigación, verificamos que: I) Brasil creó el instituto por ley, la cual fue suspendida por su Tribunal Constitucional, lo que resultó en la vuelta de su sistema anterior sin juez de garantías; y II) España sigue con un sistema procesal penal basado en el juez instructor, en el cual la presencia del juez de garantías es medida excepcional.

The present research aims to study the legal institute of the judge of guarantees. After an initial understanding of such a legal institute, especially its concept, its characteristics and the foundations that would justify its institution, we will analyze the relationship with the Brazilian and Spanish legal systems. In such research, we verified that: I) Brazil created the institute by law, which was suspended by its Constitutional Court, which resulted in the return of its previous system without a judge of guarantees; and II) Spain continues with a criminal procedure system based on the investigating judge, in which the presence of the guarantee judge is an exceptional measure.
