Resumen de Crisis y renovación metodológica en la teoría del Estado de la Repú-blica de Weimar. Un examen de las consideraciones de método de Hermann Heller y Rudolf Smend

  El propósito de este artículo es examinar los aportes que Hermann Heller y Rudolf Smend hicieron al diagnóstico crítico y a la renovación metodológica de la teoría del Estado en el contexto de la disputa por el método en la Re-pública de Weimar. A estos fines, se prevé una división tripartita. En primer lugar, en virtud de la importancia que tuvo para la denominada “disputa por el método”, se ofrece una visión panorámica de la disputa teórico-estatal que se produjo en la segunda mitad del siglo XIX. Seguidamente, se indagan los escritos de Heller y Smend a fin de ganar claridad sobre los motivos que los llevaron a diagnosticar la crisis de la teoría del Estado en la década de 1920. En tercer lugar, teniendo en cuenta los fundamentos de esa situación crítica, se presentan las propuestas con las que ambos autores pretendieron superar metodológicamente aquella crisis fundando la teoría del Estado sobre las ciencias del espíritu. Por último, se añade un apartado de conclusiones en el que se recapitulan los principales argumentos del artículo

  The aim of this paper is to explore the contributions to the critical diagnosis and to the methodological update of the theory of the state in the Weimar Republic made by Hermann Heller and Rudolf Smend. To this end, we split this paper into three sections. After considering the importance it had to the so-called “quarrel over methods”, in the first section we provide a bird’s eye view of the theory of the state of the 19th century and its debates. After that, in the second section we research into the works of Heller and Smend to highlight the main reasons that led both theorists to declare the crisis of the theory of the state during the Weimar Republic. By considering these mo-tives, in the third section we analyze the methodological attempts of Heller and Smend to overcome that critical situation through the foundation of the theory of the state on the sciences of mind. Finally, we include an additional section that sums up the most important arguments that were developed.
