Los límites al derecho de reunión durante las jornadas de reflexión y votación: la veda electoral en España

    La legislación electoral española prohíbe realizar actos de propaganda o campaña electoral durante las jornadas de reflexión y votación (veda electoral), lo cual, en ocasiones, puede confrontarse con el ejercicio del derecho de reunión.

    En tal sentido, el objeto de este artículo es analizar la doctrina de la Junta Electoral Central (jec), del Poder Judicial y del Tribunal Constitucional españoles acerca de la modulación, la permisión y la prohibición de las reuniones en lugares abiertos al tránsito público (concentraciones y manifestaciones) durante las jornadas de reflexión y votación. Para ello, tras una sucinta revisión de la estructura y las funciones de la Administración Electoral española y de la naturaleza del derecho de reunión y sus limitaciones, se abordan los acuerdos más relevantes de la jec en la materia: tanto el relativo a las concentraciones del movimiento 15-M como el derivado de los actos del Tsunami Democràtic, así como otros de notable interés, entre los que se encuentra el acuerdo sobre las manifestaciones derivadas del atentado terrorista del 11 de marzo de 2004

    The Spanish electoral legislation forbids electoral propaganda or political campaigning during the reflection and election days (election silence). This can sometimes conflict with the exercise of the right of assembly.

    In this sense, the aim of the article is to analyse the doctrine of the Spanish Central Electoral Commission, the Judiciary and the Constitutional Court on the modulation, permission and prohibition of meetings in places open to public traffic (rallies and demonstrations) during the days of reflection and election. To this end, after a brief review of the structure and functions of the Spanish electoral administration, and considering the nature of the right of assembly and its limitations, the article deals with the most relevant agreements of the Central Electoral Commission on the field; both that relating to the 15-M Movement rallies and that arising from the Tsunami Democràtic events, as well as others of great interest, including the Agreement on the demonstrations after the 2004 Madrid train bombings
