Resumen de ¿La universidad estatal es un servicio público?

En el presente trabajo, a partir de un caso suscitado ante el Tribunal Constitucional Chileno, se intenta revisar si la universidad estatal ha de considerarse como un servicio público. Para ello, se pasará una somera revista de este concepto político- jurídico, tanto desde el punto de vista jurídico como de las ciencias económicas. Ello así pues consideramos que el aporte de esta última ciencia puede contribuir a limitar la indeterminación y politización que ha sufrido este concepto a lo largo de la doctrina y la jurisprudencia y, de este modo, contribuir a salvaguardar la naturaleza de la primera y dar un contenido material y verificable al segundo. En pocas palabras, fortalecer el Estado de Derecho.

In this paper, based on a case brought before the Chilean Constitutional Court, an attempt is made to review whether the state university should be considered as a public service. For this, a brief review of this political-legal concept will be passed, both from the legal point of view and from the economic sciences. Thus, we consider that the contribution of the latter science can help to limit the indeterminacy and politicization that this concept has suffered throughout the doctrine and jurisprudence and, in this way, contribute to safeguard the nature of the former and give a material and verifiable content to the second. In short, strengthen the rule of law.
