  En el presente artículo se presentan los componentes más significativos de la investigación cualitativa, los datos, los procedimientos analíticos e interpretativos de esos datos y los informes que contienen los resultados o teorías. Así, se propone la aplicación de la metodología crítica, como una disciplina metacognitiva e interdisciplinaria, procediendo al análisis de procesos judiciales vinculados a los Derechos Humanos desde las escalas Macro, Meso y Micro de un proceso de investigación. Puntualizando en la escala Micro, se compararán la fase sincrética o de ideación con la etapa expositiva de un proceso judicial; la fase analítica con el período probatorio y la fase sintética con la sentencia judicial. Siguiendo un proceso constructivo, en el sistema de matrices se ubicarán los distintos componentes del dato y las relaciones lógico- metodológicas entre los niveles Supraunitario, de anclaje y Subunitario. Las sentencias judiciales que fallan sobre derechos humanos, en especial, el derecho al trabajo y el derecho a la intimidad, constituirán Unidades de Análisis de una matriz a la luz de la metodología crítica.

  This article presents the most significant components of qualitative research, the data, the analytical and interpretative procedures for those data, and the reports that contain the results or theories. The application of the critical methodology is proposed, as a metacognitive and interdisciplinary discipline, proceeding to the analysis of judicial processes related to Human Rights from the Macro, Meso and Micro scales of a research process. Pointing out the Micro scale, the syncretic or ideation phase will be compared with the expository stage of a judicial process; the analytical phase with the probationary period and the synthetic phase with the judicial sentence. Following a constructive process, the different components of the data and the logical-methodological relationships between the Supra-unit, anchor and Sub-unit levels will be located in the matrix system.  Judicial rulings that rule on human rights, especially the right to work and the right to privacy, will constitute Units of Analysis of a matrix in light of the critical methodology.
