Following in the footsteps of the 1951 Padua lecture series ‘the crisis of law’, this paper demonstrates the contemporaneity of this debate, which prompts a serious re-thinking of the law as a social phenomenon. It argues that, normatively, the law is now more than ever going through a season of legal dualism, as it varies with the purpose for which it is being interpreted. Understood this way, the law sees human rights (as well as human identities and their related beliefs) both as an economic choice ‘within’ the market, but also as a phenomenon requiring protection ‘from’ the market, as this article attempts to explain.
