Resumen de Atipicidad de la necrofilia y la vulneración de derechos de la familia del difunto

  La necrofilia es una problemática social latente, que ha sido renegada e invisibilizada por el Estado ecuatoriano. Este comportamiento atípico atenta no solo contra el bienestar de las personas que se ven afligidas por las consecuencias de dicha conducta, como lo son la familia del difunto y sus allegados, sino también la sociedad en general. Este tipo penal, se encuentra previsto en múltiples legislaciones a nivel internacional de diferentes formas, sin embargo, aún pese a los casos existentes es totalmente ignorado en el contexto ecuatoriano. La presente investigación jurídica y documental, resalta la carencia de normativa vinculada a la necrofilia en el Ecuador en el Código Orgánico Integral Penal (COIP), mediante su análisis. Además, subraya la necesidad del apoyo estatal para tipificar esta anomia, a fin de resguardar los derechos vinculados a la familia del difunto como integridad psíquica, dignidad, debida defensa entre otros, permitiendo a estos acudir a la justicia y resguardar los mismos.

  Necrophilia is a latent social problem, which has been denied and made invisible by the Ecuadorian State. This atypical behavior threatens not only the well-being of people who are afflicted by the consequences of said behavior, such as the family of the deceased and those close to him, but also society in general. This type of crime is provided for in multiple international legislations in different ways; however, even despite existing cases, it is completely ignored in the Ecuadorian context. The present legal and documentary investigation highlights the lack of regulations linked to necrophilia in Ecuador in the Comprehensive Organic Penal Code (COIP), through its analysis.

  Furthermore, it highlights the need for state support to classify this anomie, in order to protect the rights linked to the family of the deceased such as mental integrity, dignity, due defense among others, allowing them to go to justice and protect them.
