El Tribunal de Casación de Bélgica confirma que, aunque la función arbitral tiene carácter personal e indelegable, ello no impide la participación de la secretaria del tribunal arbitral en la redacción de partes relevantes del laudo arbitral. Salvo que las partes acuerden otros límites, la cuestión esencial es la revisión personal del expediente por los árbitros y su corrección o validación última de la decisión o laudo.

The Belgian Court of Cassation confirms that, even if the arbitral function is personal and cannot be delegated, this does not prevent the participation of the secretary of the arbitral tribunal in the drafting of relevant portions of the arbitral award. Unless the parties agree other restrictions, the essential issue is the personal review of the file by the arbitrators and the ultimate correction or validation of the decision or award.
