Resumen de Normativa migratoria en Chile: algunos comentarios en perspectiva de derechos respecto a los DESCA

  Durante los últimos años en Chile los derechos de las personas migrantes han sido objeto de debate nacional, esto producto de la entrada en vigor, durante el año 2022 de la Ley de Migración y Extranjería, que por una parte viene a modernizar la institucionalidad migratoria y a establecer principios y derechos. Pero también, otra instancia de discusión en la materia se ha producido en los procesos constituyentes. La principal temática de análisis de este texto será como la nueva regulación aborda los derechos económicos, sociales, culturales y ambientales(DESCA).

  In the last years in Chile the discussion about migrant’s human rights has become a subject of national debate, especially regarding the in force in 2022 of new law of migration and foreign affairs, it´s main objective was to modernize migration institutions and to establish principles and rights. But also, there is another instance of discussion in the matter which are the constitutional processes. The main theme of analysis of this document is how the new legal regulation approaches the economic, social, cultural, and environmental rights.
