Resumen de Práctica y agotamiento del derecho de abintestato en el cabildo catedral de Sevilla

  Desde la Edad Media fue un privilegio del cabildo catedral hispalense heredar a sus miembros fallecidos en abintestato. Esta costumbre se fue perfeccionando a lo largo de los siglos gracias a su práctica. Sin embargo, en el siglo XVIII comenzó a debilitarse este derecho de la institución ante el aumento de poder del Estado y la justicia real. Temiéndose su extinción por mandato judicial la institución procuró alargar la existencia de este derecho mediante la negociación y la discreción en la ejecución de estas herencias. En esta investigación analizaremos el final de esta práctica en el cabildo catedral de Sevilla

  Since the Middle Ages, the cathedral chapter of Seville had the privilege to inherit its deceased members in intestacy. This custom was perfected over the centuries thanks to its practice. However, in the 18th century, this right of this institution began to weaken due to the increase in power of the State and Ro-yal Justice. Fearing its extinction by court order, the institution sought to prolong the existence of this right through negotiation and discretion in the execution of these inheritances. In this investigation we will analyse the end of this practice inthe cathedral chapter of Seville
