El delito de defraudación tributaria tiene particularidades especiales que a través del tiempo han complicado su investigación, ya que en un principio cuando este delito se encontraba en el libro IV del Código Tributario exigía como requisito de procedibilidad la determinación hecha por el sujeto activo y en dicho acto administrativo debía establecerse la presunción de la responsabilidad penal, luego a la vigencia del Código Orgánico Integral Penal COIP, se mantiene la determinación tributaria de manera general como requisito sine qua non, y; finalmente en una posterior reforma al COIP se cambia la obligatoriedad de que exista una determinación tributaria por las actuaciones que induzcan a error a la administración tributaria, siendo la administración tributaria un elemento del tipo conceptualmente más amplio que la facultad determinadora o la autodeterminación. El presente artículo por tanto es un aporte respecto al análisis e interpretación correcta que debe darse al delito de defraudación desde el punto de vista de su evolución y el momento en el que se haya cometido la presunta infracción de tipo penal.

Therefore, this article is a contribution to the analysis and correct interpretation that should be given to the crime of fraud from the point of view of its evolution and the moment in which the alleged criminal offense was committed.
