Resumen de Democracia defensiva na Alemanha e no Brasil na prática de hoje: paralelos entre o Bundesamt für Verfassungsschutz (BfV) e a Procuradoria Nacional da União de defesa da democracia

  The subject “defensive democracy” came back in Brazil during the government of former President Jair Bolsonaro, since the other two Branches identified the need to fight the democratic erosion provoked by him. With the recent change of government, the Executive Branch, reportedly inspired by the alluded theory, created an office for the defense of democracy, under the supervision of the Attorney General, whose main goal is to protect the integrity of the public action and the preservation of the three Branches and their members, ensuring the exercise of their constitutional functions. The Brazilian Office for Democracy Defense follows the example set by Germany in the second post-war period, when this European country created, for the same reasons, the Federal Office for the Protection of the Constitution (BfV). Based on this background, the main goal of this paper is to present the two government initiatives mentioned above, in addition to tracing the possible parallels between Germany and Brazil in the creation of a culture of “defensive democracy” and, what is more relevant, in the effective defense of democracy.

  O tema “democracia defensiva” voltou à baila durante o governo do ex-Presidente da República Jair Bolsonaro, uma vez que os demais poderes identificaram a necessidade de combater ativamente a erosão democrática por ele provocada. Com a recente troca de governo, o Poder Executivo Federal, declaradamente inspirado na aludida teoria, criou a Procuradoria Nacional da União de Defesa da Democracia da Advocacia-Geral da União com o escopo principal de defender judicialmente a integridade da ação pública e a preservação da legitimação dos três Poderes e de seus membros para o exercício de suas funções constitucionais. A iniciativa brasileira segue o exemplo dado pela Alemanha do segundo pós-guerra, que criou, pelos mesmos motivos, o Serviço Federal para a Proteção da Constituição da Alemanha (BfV). Com base nesse pano de fundo, o presente artigo científico tem por objetivo principal apresentar as duas iniciativas governamentais acima referidas, além de traçar os paralelos possíveis entre Alemanha e Brasil na criação de uma cultura de “democracia defensiva” e, o que é mais relevante, na efetiva defesa da democracia.
