    El estudio de las condiciones de acceso al estatuto de protección, establecido por la Ley 2/2023, se aborda en este trabajo destacando que el marco legal convive con el marco de tutela, diseñado por la doctrina jurisprudencial, al amparo de los derechos de libertad de información y de expresión, para las personas que alertan sobre infracciones o irregularidades con relevancia para el interés público. Consecuentemente, se examinan las relaciones entre el estándar legal y el judicial de protección de la persona informante, en caso de revelación pública directamente a la prensa. Finalmente, se pone de manifiesto el déficit de la regulación legal, tanto en relación con la acreditación de la condición de persona informante como en la concreción de las medidas de protección que integran el referido estatuto protector.

    The study of the conditions of access to the statute of protection, established by Law 2/2023, is addressed in this work, highlighting that the legal framework coexists with the framework of protection, designed by the jurisprudential doctrine, under the protection of the rights of freedom of information and expression, for persons who warn about infractions or irregularities with relevance to the public interest. Consequently, the relationship between the legal and judicial standard of protection of the informant, in case of public disclosure directly to the press, is examined. Finally, the deficit of the legal regulation is highlighted, both in relation to the accreditation of the status of whistleblower and in the specification of the protection measures that make up the aforementioned protective statute.
