La defensa técnica activa en la investigación previa dentro del sistema oral acusatorio ecuatoriano

    La presente investigación tiene como objetivo de estudio, establecer el ejercicio de la defensa técnica activa durante la investigación previa, a fin de no activar de manera innecesaria el órgano punitivo del Estado. Para el efecto se realizó una investigación descriptiva y explicativa, con enfoque cualitativo, para ello se presentó el análisis dogmático jurídico aplicado del derecho a la defensa desde la jurisprudencia, la norma constitucional y penal, así mismo se realizó una investigación de campo, por medio de entrevistas a los sujetos que intervienen dentro de la investigación previa: jueces, fiscales, defensores públicos y abogados litigantes, a fin de recabar información del ejercicio activo o pasivo de la defensa técnica en la fase pre procesal. Este estudio constituye una crítica importante para conocer qué postura o modalidad de la defensa escoger en la investigación previa dentro del sistema oral acusatorio ecuatoriano.

    The objective of this investigation is to establish the exercise of active technical defense during the previous investigation, in order not to unnecessarily activate the punitive body of the State. For this purpose, a descriptive and explanatory research was carried out, with a qualitative approach, for this the dogmatic legal analysis applied to the right to defense from jurisprudence, constitutional and criminal law was presented, likewise a field investigation was carried out, through of interviews with the subjects involved in the preliminary investigation: judges, prosecutors, public defenders and trial lawyers, in order to gather information on the active or passive exercise of technical defense in the pre-procedural phase. This study constitutes an important critique to know what position or mode of defense to choose in the prior investigation within the Ecuadorian oral accusatory system.
