Resumen de El desarrollo por parte de la CIJ del concepto de la comunidad de intereses en la gestión de las aguas compartidas y su impacto en el Derecho de la Unión Europea

En el presente artículo, tras un análisis somero de las teorías existentes para la gestión y el reparto de los recursos hídricos compartidos, acometemos un estudio sobre la aparición y contenido normativo del concepto y teoría de la "comunidad de intereses". Así, recorremos su evolución desde que el concepto fue planteado por el Tribunal Permanente de Justicia Internacional hasta que fue concretado por la CIJ y otros órganos jurisdiccionales internacionales, pues éstos han jugado un papel crucial en su definición y contextualización. Posteriormente desentrañamos el contenido normativo del concepto, dedicando especial atención a su impacto en el establecimiento y contenido del Derecho de la Unión Europea para la gestión de los recursos hídricos.

In this article, after a brief analysis of existing theories for the management and distribution of shared water resources, we undertake a study on the emergence and normative content of the concept and theory of the "community of interests". Thus, we trace its evolution from when the concept was proposed by the Permanent Court of International Justice until it was specified by the ICJ and other international judicial bodies, as they have played a crucial role in its definition and contextualization. Subsequently, we unravel the normative content of the concept, paying special attention to its impact on the establishment and content of European Union Law for the management of water resources.
