Resumen de Maltrato animal y custodia de menores en el artículo 92.7 del Código Civil español

Este artículo analiza los fundamentos e implicaciones de la reforma del artículo 92.7 del Código Civil, relativa a la introducción de los malos tratos a animales, o la amenaza de causarlos, como motivo para denegar judicialmente a un progenitor la guarda y custodia de sus hijos o hijas. Esta modificación supone el reconocimiento, en el orden civil, de que el maltrato a los animales es una conducta violenta que, tal como documenta una amplia literatura científica, resulta dañina en sí misma para los menores que la presencian, se encuentra asociada a la violencia de género y doméstica, así como al maltrato infantil, y además puede ser instrumentalizada para coaccionar o hacer sufrir al menor o a otros miembros de la familia. Motivos todos ellos por los que la existencia de maltrato animal debe ser siempre atendida y considerada a la hora de adoptar decisiones relativas a la protección de los menores y que justifican la modificación introducida en el precepto analizado por la Ley 17/2021.

This article analyzes the reasons and implications of the reform of article 92.7 of the Spanish Civil Code, which has included animal abuse, or the threat of causing it, as a reason to judicially deny the guardianship and custody of a child. This amendmententails the legal recognition, in the civil law in Spain, that animal abuse is a violent conduct that, as documented by a substantial body of scientific literature, is itself harmful for minors who witness it; that it is related to intimate partner violence against women and domestic violence, as well as to child abuse; and which can also be instrumentalized to coerce or make the minor or other family members suffer. All of them are reasons why the presence of animal abuse must always be considered when adopting decisions related to the protection of minors and that justify the amendment of the article of the Civil Code examined, by Act 17/2021
