    O sistema binário pode ser interpretado como aquele que se baseia em critérios rígidos de padrões duplos. O binarismo de gênero tem como uma de suas características a divisão de locais em função das duas únicas opções que oferece às pessoas, levando em conta o sexo biológico, criando sítios específicos para o público feminino ou masculino. O presente trabalho busca demonstrar a violência de gênero como uma construção social refletida na prisão, e compreender o paradoxo existente entre a dignidade da pessoa humana e o direito à identidade e autoafirmação do transgênero encarcerado diante de um Estado binário. Ao longo da pesquisa, ficará clara a falha organizacional desse instituto rígido, tendo em vista o choque com os direitos de transexuais e travestis. Metodologicamente, a pesquisa analisou o problema jurídico de maneira bibliográfica e documental, além da análise de dados sobre os sistemas prisionais de Brasil e Portugal, com um breve estudo de direito comparado com a Itália, buscando possíveis soluções para maior proteção da população transgênero em situação de cárcere. Defender- se- á, ao final, a necessidade de estabelecimentos prisionais exclusivos para esses indivíduos, objetivando a mitigação da violência de gênero e desmantelando a existência de apenas duas categorias de enquadramento para a alocação dos presos.

    The binary system can be interpreted as the strict criteria of double standards. Gender binarism has as one of its characteristics the division of places due to the two only options it offers to people, considering biological sex, creating specific sites for the female or male audience. The present work seeks to demonstrate gender violence as a social construction reflected in prison, and to understand the paradox between the dignity of the human person and the right to identity and self-affirmation of trans- gender incarcerated before a binary state. Throughout the research, it will be clear the organizational failure of this rigid institute, in view of the clash with the rights of transsexuals and transvestites. Methodologically, the re- search analyzed the legal problem in a bibliographic and documentary way, in addition to the analysis of data on the prison systems of Brazil and Portugal, with a brief study of law compared with Italy, seeking viable solutions for greater protection of the trans-gender population in prison situation. In the end, the need for exclusive prisons for these individuals will be defended, aiming at mitigating gender violence, and dismantling the existence of only two categories of framework for the allocation of prisoners.
