Notas sobre el asedio judicial a la inmunidad parlamentaria en Venezuela

    La inmunidad parlamentaria es un régimen jurídico especial aplicable a los parlamentarios en razón de su pertenencia al cuerpo legislativo, establecido en la Constitución como una garantía de la autonomía del Poder Legislativo en el ejercicio de sus funciones y frente a sus interacciones con el Poder Ejecutivo, grata y necesaria al Principio de Separación de Poderes. Ahora bien, en un momento donde es evidente el enfrentamiento entre el Poder Legislativo, por una parte, y el Poder Ejecutivo y Judicial, por la otra, no es extraño observar, lo que está ocurriendo: que por vía jurisprudencial se está desintegrando el contenido alcance de la inmunidad. La estrategia –en esta confrontación de poderes– es simple, acabar con la inmunidad parlamentaria para facilitar el ataque judicial de los parlamentarios y así acabar con la autonomía del Parlamento.

    Parliamentary immunity is a special legal regime applicable to parliamentarians because of their membership in Parliament. It is established in the Constitution as a guarantee of the autonomy of the Legislative Power in the exercise of their functions and in the face of their interactions with the Executive Power, pleasant and necessary to the Principle of Separation of Powers. Now, at a time when the confrontation between the Legislative Power, on the one hand, and the Executive and Judicial Power, on the other, is happening, is not surprising to observe that the scope of immunity content it’s been disintegrating by jurisprudential means. The strategy –in this confrontation of powers– is simple, ending the Parliamentary immunity facilitate the judicial attack of parliamentarians and thus end the autonomy of Parliament.
