    El proceso constituyente en Chile se basa en un acuerdo de las principales fuerzas políticas del Congreso, traducido luego en una reforma a la Constitución vigente, que establece un marco regulado para que una Convención Constitucional pueda elaborar una nueva carta fundamental. Se analizan las instituciones y las normas de derecho civil que están mencionadas en la Constitución actual y luego se trazan algunas perspectivas de lo que podría ser la recepción del derecho civil en la nueva Constitución, partiendo de la base de lo que se señala en los tratados internacionales ratificados por el Estado de Chile, así como otras constituciones de naciones cultural y jurídicamente próximas a la sociedad chilena.

    The constituent process in Chile is based on an agreement of the main political forces in Congress, later translated into an amendment to the current Constitution, which establishes a regulated framework so that a Constitutional Convention can develop a new Fundamental Charter. The institutions and norms of civil law that are currently mentioned in the current Constitution are analyzed and then some perspectives are given of what could be the reception of civil law in the new Constitution, based on what is indicated in the treaties ratified by the State of Chile, as well as other Constitutions of cultural and legal nations close to Chilean society.
