O bullying ocorrido em escolas em recursos judiciais paulistas: uma luta por reconhecimento

    No presente artigo, por meio de recursos do Tribunal de Justiça de São Paulo, no período de 2018 e 2019, buscou-se verificar como esse tribunal tem resolvido os conflitos de bullying na escola. Fizemos, ainda, uma apreciação desse material considerando a Teoria da luta por reconhecimento, de Axel Honneth, desenvolvida em sua obra Luta por reconhecimento: a gramática moral dos conflitos sociais. O método da pesquisa foi bibliográfico, em literatura da Educação e do Direito, e em referências bibliográficas que estudaram Axel Honneth. Também utilizamos o método documental e histórico, fazendo-se a análise dos recursos. Neste artigo, visamos estudar o bullying, descrever os casos por meio dos recursos e entender os meios para minimizar essa violência. Como objetivo principal, pretende-se demonstrar como as ações que envolvem conflitos de violência na escola chegam ao Poder Judiciário paulista, em especial o bullying, e como este órgão tem resolvido e tratado do assunto. Usamos a teoria de Axel Honneth para mostrar esse fenômeno social, o bullying na escola, que acontece quando são desrespeitados os direitos da pessoa. Assim, este artigo enseja mostrar que, a despeito de ocorrer o bullying no ambiente escolar, a escola é um lugar de luta por reconhecimento jurídico dos seus atores, ao buscarem a autorrealização por meio da ordem jurídica e social.

    In this article, through appeals from the Court of Justice of São Paulo, in the period 2018 and 2019, we sought to verify how this court has resolved bullying conflicts at school. We also made an appreciation of this material against Axel Honneth’s Theory of the “struggle for recognition”, developed in his work Fight for recognition: the moral grammar of social conflicts. The research method was bibliographic, in Education and Law literature, and in bibliographical references that studied Axel Honneth. We also used the documental and historical method, analyzing the resources. In this article,we aim at the objectives: to study bullying, to describe the cases through the resources and to understand the means to minimize this violence. As a main objective, it is intended to demonstrate how actions involving conflicts of violence at school, especially bullying, reach the Judiciary Power in São Paulo, and how this body has resolved and dealt with the matter. We use Axel Honneth’s theory to show this social phenomenon, bullying at school, which happens when people’s rights are disrespected. Thus, this manuscript aims to show that despite bullying occurring in the school environment, the school is a place of struggle for legal recognition of its actors, as they seek self-realization through the legal and social order.
