Los Medios no Adversariales con Base en los Derechos Fundamentales

    Este estudio ha tratado sobre los Medios no Adversariales con Base en los Derechos Fundamentales que apuntan al incremento del acceso a la justicia mediante la alternativa del logro de acuerdos justos. Según el nivel la investigación fue de tipo descriptivo, su estudio fue de carácter documental-teórico, donde se indagó en la bibliografía lo relacionado con los medios adecuados de solución de controversias, su diseño correspondió a una investigación  no experimental, las técnicas utilizadas para recolectar los datos fue el análisis documental. Los principales resultados encontrados fue que los medios no adversariales son aquellos en los cuales las partes en conflicto resuelven directamente su diferencia, pudiendo ser en ocasiones intervenidos por un tercero neutral sin intervención del mismo. Los principales medios no adversariales son: la negociación, la cual se constituye en un proceso directo que existe entre dos o más partes que enfrentan un conflicto. La mediación la cual apunta al incremento del acceso a la justicia mediante la alternativa del logro de acuerdos justos, y la que consiste en un intento de llegar voluntariamente a un acuerdo mutuo las partes, en que puede ayudar un tercero quien interviene entre los contendientes en forma oficiosa y desestructurada, para dirigir la discusión sin un rol activo. Los derechos fundamentales son inherentes a la dignidad, es decir, cada uno de los derechos fundamentales manifiesta un núcleo de existencia humana que se deriva de la dignidad que tiene la persona, por ello, la dignidad se convierte en una fuente de los derechos de la persona.

    This study is about Non-Adversarial Conflict Resolutions Procedures on the Basis of Fundamental Rights that aim to increase the access to justice achieving fair agreements. The research was descriptive, its study was of a documentary-theoretical nature, where the bibliography was investigated regarding the appropriate means of dispute resolution, its design corresponded to a non-experimental investigation, the techniques used to collect the data was documentary analysis. The main results found were that non-adversarial conflict resolutions are those in which the conflicting parties directly resolve their difference, and can sometimes be intervened by a neutral third party without its intervention. The main non-adverbial conflict resolutions procedures are: negotiation, which is constituted in a direct process that exists between two or more parties that face a conflict. Mediation which aims to increase access to justice through the alternative of achieving fair agreements. and the one that consists of an attempt to voluntarily reach a mutual agreement between the parties, in which a third party can help who intervenes between the contenders in an informal and unstructured way, to direct the discussion without an active role. Fundamental rights are inherent to dignity, that is, each of the fundamental rights manifests a nucleus of human existence that derives from the dignity that the person has, therefore dignity becomes a source of the rights of the person.
