    El presente artículo realiza una aproximación a la propiedad industrial en Colombia y a nivel internacional, con un enfoque hacia las marcas, su definición y regulación. Para lograr lo anterior, se hará un breve recuento sobre lo dicho por la Superintendencia de Industria y Comercio de Colombia, la Organización Mundial de la Propiedad Industrial, la Comunidad Andina de Naciones, el Protocolo de Madrid y la Organización Mundial del Comercio trayendo a discusión una serie de controversias que se han dirimido en dicha Organización. Lo anterior, con miras a definir cuáles son los derechos positivos y negativos que son otorgados al titular de una marca registrada y las diferentes posturas frente a esto.

    This article makes an approach to industrial property in Colombia and internationally, with a focus on Trademarks, their definition and regulation. To achieve the above, a brief account will be made of what was said by the Superintendence of Industry and Commerce of Colombia, the World Intellectual Property Organization, the Andean Community of Nations, the Madrid Protocol, and the World Trade Organization, bringing to discussion a series of disputes that have been decided in said Organization. The above in pursuit of defining the positive and negative rights that are granted to the owner of a registered trademark and the different positions on this.
