The contribution offers a reflection on the recovery of public resources used in extraordinary measures tosupport businesses. The author, after having retraced the doctrinal and jurisprudential debate on the subject, focuses on the procedures for submitting the preferential credit claimed by Sace to the liabilities, as well as on the problems connected to the extinction of the guarantee. In this perspective, it is highlighted that the public law discipline of the sector, aimed at guaranteeing the State the recovery of the resources used, in some circumstances prevails over the civil one.

Il contributo offre una riflessione sull’azione di recupero delle risorse pubbliche impiegate nelle misure straordinarie di sostegno alle imprese. L’a., dopo aver ripercorso il dibattito dottrinale e giurisprudenziale sul tema, si sofferma sulle modalità d’insinuazione al passivo del credito privilegiato vantato dalla Sace, nonché sulle problematiche collegate all’intervenuta estinzione della garanzia. In questa prospettiva si pone in evidenza che la disciplina pubblicistica di settore, finalizzata a garantire allo Stato il recupero delle risorse impiegate, in alcune circostanze prevale su quella civilistica.
