  Este artículo fundamenta la sentencia de la Corte Suprema de Chile en favor de Leopoldo López y Daniel Ceballos de Noviembre de 2015 en la razón de humanidad que pernea desde 1948 el Derecho Internacional, desplazando al estado y sus derechos como el sujeto de su mayor importancia. La persona con su dignidad y derechos es el sujeto preeminente de Derecho Internacional y Constitucional, sin distinción posible, quienes pueden usar la red del Estado de Derecho a través de la Doctrina de Jurisdicción Universal, en su defensa y protección.

  This article position the Chilean Supreme Court ruling in favor of Leopoldo López and Daniel Ceballos of November 2015, on the reason of humanity that permeates since 1948 the International Law, shifting the State from its role as the most important subject and its rights. The person, with their dignities and rights are the preeminent subject of the International and Constitutional Law, without any possible distinction, allowing them to use the Rule of Law and its net described on the Doctrine of Universal Jurisdiction for their defense and protection.
