Resumen de O impacto do teletrabalho na saúde do trabalhador: uma análise do papel do empregador na preservação da saúde laboral, sob a óptica da integridade do Direito de Dworkin

  Considering that a portion of workers has recently migrated to telework-ing without planning for occupational health, the following issues are addressed: is it up to companies to establish protective mechanisms to guarantee health in teleworking? Does the identification of risks in the domestic environment infringe Article 5, items X and XI, of the Brazilian Constitution? The objectives are: i) to identify the characteristics of teleworking; ii) to describe the employer’s obligation regarding the health of its employees; iii) to analyze the apparent conflict between the constitutional norms of health preservation, intimacy, and privacy. It is concluded that the State must regulate teleworking and companies must establish mechanisms aimed at preserving the health of their workers.

  Considerando que uma parcela dos trabalhadores recentemente migrou para o teletrabalho sem planejamento quanto à saúde ocupacional, abordam-se as seguintes questões: cabe às empresas estabelecer mecanismos protetivos para garantir a saúde em teletrabalho? A identificação de riscos no ambiente doméstico infringe o artigo 5, inci-sos X e XI, da Constituição brasileira? Os objetivos são: i) identificar as características do teletrabalho; ii) descrever a obrigação do empregador quanto à saúde de seus empregados; iii) analisar o conflito aparente entre as normas constitucionais de preservação da saúde e da intimidade e privacidade. Conclui-se que o Estado deve regulamentar o teletrabalho e as empresas devem estabelecer mecanismos visando à preservação da saúde de seus trabalhadores em teletrabalho
