Neuroderechos: Derecho a la salud, derechos fundamentales, y nuevos retos en torno a su regulación

    El debate en torno a los neuroderechos está ganando cada vez mayor atención entre juristas, científicos y académicos, si bien aún no ha permeado en el discurso social. Su estado de desarrollo es todavía embrionario, y existen posturas contrapuestas en cuanto a su oportunidad de regularlos y cómo afrontar la configuración legal de un fenómeno cuyas consecuencias tan solo pueden aventurarse. Sin dudas, existen dos áreas bien establecidas donde cuya protección, sin duda, alcanza a los neuroderechos. De un lado, el derecho a la salud, con interesantes progresos en medicina experimental para enfermedades mentales, neurodegenerativas y en lesiones del sistema nervioso. Del otro, el derecho de la persona, más concretamente, en la esfera de sus derechos fundamentales, que garantizan la protección a la dignidad de la persona, el libre desarrollo de su personalidad, la integridad física y moral y la intimidad, entre otros. En este trabajo, efectuamos una mirada crítica al presente y al futuro de los neuroderechos, a la luz de las actuales propuestas y los últimos desarrollos doctrinales y académicos en torno a ellas.

    The neurorights debate is gaining momentum among jurists, scientists, and academics, although it has not yet permeated to the general public or the social discourse. Its development is still in its infancy, and there are contrasting views regarding the opportunity to regulate them and how to address the legal configuration of a phenomenon whose consequences can only be speculated upon. Without a doubt, there are two well-established areas where the protection of neurorights undoubtedly extends.

    On one hand, the right to health, with interesting advancements in experimental medicine for mental illnesses, neurodegenerative diseases, and nervous system injuries. On the other hand, the individual’s rights, more specifically, in the sphere of their fundamental rights, which guarantee protection of human dignity, the free development of one’s personality, physical and moral integrity, and privacy, among others. In this work, we take a critical look at the present and future of neurorights, in light of current proposals and the latest doctrinal and academic developments surrounding them.
