Resumen de Análisis crítico de la STC 172/2020 (Pleno) en cuanto a la constitucionalidad del artículo 20.2b de la Ley de Seguridad Ciudadana

  La sentencia del Tribunal Constitucional 172/2020, del 19 de noviembre, ha resuelto reciente y definitivamente el Recurso de Inconstitucionalidad 2896/2015, interpuesto en contra ex artículo 20.2 de la Ley de Seguridad Ciudadana. Su redacción se ajusta al marco constitucional, ya que, según se arguye en la misma, no vulnera el derecho a la intimidad corporal establecido en el artículo 18.1 de la Constitución Española. A la luz de la presente sentencia, se ha realizado un estudio minucioso sobre los aspectos más relevantes de esta figura de prospección corporal que hemos denominado “desnudo parcial”, encuadrada en el apartado “b” ex artículo 20.2, que de su tenor literal expresa como “dejar a la vista partes del cuerpo normalmente cubiertas por ropa”.

  The judgment of the Constitutional Court 172/2020, of November 19, has recently and definitively resolved the unconstitutionality appeal 2896/2015, filed against ex art. 20.2 of the Law of Citizen Security.

  Its wording conforms to the constitutional framework, since, as argued therein, it does not violate the right to bodily privacy of art. 18.1 of the Spanish Constitution. In light of this judgment, a meticulous study has been carried out on the most relevant aspects of this figure of body prospection that we have called “partial nakedness”, which is framed in section “b” ex art. 20.2, and which defines it in its literal wording as:

  “exposing parts of the body normally covered by clothing”.
