Resumen de Vulneración del derecho a la vivienda del presunto contraventor de violencia de género

  El objetivo general de la investigación fue analizar jurídicamente la vulneración del derecho a la vivienda del presunto contraventor de violencia de género. La investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Se apoyó en la revisión documental-bibliográfica de artículos arbitrados, leyes y normas. Además, se aplicó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se concluye que, la violencia intrafamiliar es un fenómeno que se encuentra arraigado en la sociedad ecuatoriana, y así ha sido evidenciado por encuestas e instrumentos de medición presentados por los órganos del Estado. La legislación penal en ese contexto, representada por el COIP, es llamada a atender los casos en los cuales ya se ha materializado la acción, es decir, cuando ya se ha perpetrado el delito de violencia contra la mujer o algún miembro del grupo familiar.

  The general objective of the research was to legally analyze the violation of the right to housing of the alleged offender of gender violence. The research used the quantitative method which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review of refereed articles, laws and norms. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. It is concluded that domestic violence is a phenomenon that is deeply rooted in the Ecuadorian society, and this has been evidenced by surveys and measuring instruments presented by the State bodies. Criminal legislation in this context, represented by the COIP, is called upon to address cases in which the action has already materialized, that is, when the crime of violence against women or any member of the family group has already been perpetrated.
