    El objetivo general de la investigación fue analizar jurídicamente el delito de peculado: Análisis comparativo entre las legislaciones ecuatoriana, peruana y española. Se utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Apoyado en la revisión documental-bibliográfica. Además, se aplicó el método inductivo-deductivo. Se plantea además el método analítico-sintético. Se concluye que, en el delito de peculado es de mucha valía desde la perspectiva del Derecho Penal, al determinar conductas que son penalmente relevantes y que protegen bienes jurídicos que involucra la responsabilidad estatal en el manejo de bienes, que pertenecen a todos los ciudadanos.

    The general objective of the research was to legally analyze the crime of embezzlement: Comparative analysis between Ecuadorian, Peruvian and Spanish legislation. The quantitative method was used, which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. It is concluded that, in the crime of embezzlement is of great value from the perspective of Criminal Law, by determining conducts that are criminally relevant and that protect legal goods that involve the state responsibility in the management of goods, which belong to all citizens.
