  El objetivo general de la investigación fue analizar jurídicamente la dosimetría penal: Arbitrariedad normativa y práctica en el Ecuador. Se utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Se apoyó en la revisión documental-bibliográfica. Además, se aplica el método inductivo-deductivo. Se plantea además el método analítico-sintético. Se aplicó una encuesta a 27 profesionales del derecho que laboran en la Unidad Judicial Penal y Tribunal de Garantías Penales del cantón Latacunga. Se concluye que, el COIP se evidencia que existen falencias al momento del debate legislativo para la aprobación de las leyes y que, en el país impera una justicia politizada, para tipificar el mínimo y máximo de las penas dentro de esta normativa, por lo que se recomienda hacer reformas, para que los implicados sean sancionados de acuerdo a la gravedad del delito.

  The general objective of the research was to legally analyze criminal dosimetry: normative arbitrariness and practice in Ecuador. The quantitative method was used, which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. A survey was applied to 27 law professionals working in the Criminal Judicial Unit and Criminal Guarantees Court of Latacunga canton. It is concluded that the COIP shows that there are shortcomings at the time of the legislative debate for the approval of laws and that, in the country there is a politicized justice, to typify the minimum and maximum penalties within this legislation, so it is recommended to make reforms, so that those involved are punished according to the
